These Terms govern your use of CarbCue, provided by Timothy Alan Nice ("we", "us"). By creating an account or using CarbCue you agree to these Terms. If you don't agree, please don't use the service.
1. The service
CarbCue is an AI-assisted carb-estimation tool for families managing Type 1 Diabetes. It produces approximate carbohydrate estimates and an illustrative absorption curve based on photos you upload.
CarbCue is not a medical device and does not provide medical advice, insulin dosing recommendations, or blood-glucose predictions. Always verify carbs with packaging, a scale, your glucose monitor, and your care team.
2. Accounts
You must provide accurate information and keep your credentials secure. You are responsible for activity under your account. Accounts are intended for adults. If you add a family profile for a minor, you confirm you are their parent or legal guardian.
3. Acceptable use
You must not:
- Use CarbCue unlawfully or in a way that infringes others' rights.
- Attempt to reverse-engineer, scrape, or interfere with the service.
- Upload malware or content that infringes intellectual property.
- Resell, sublicense, or redistribute CarbCue without permission.
4. Intellectual property
Timothy Alan Nice retains all rights in CarbCue, including its software, branding, and documentation. We grant you a limited, non-exclusive, non-transferable right to use CarbCue within your plan.
5. Subscriptions, payment, and refunds
CarbCue is offered as a subscription with a 1-week trial that includes 10 trial analyses. After the trial, your subscription auto-renews at the rate shown at checkout until you cancel. Our order process is conducted by our online reseller Paddle.com. Paddle is the Merchant of Record for all orders. Paddle provides customer service inquiries and handles returns. Payment, billing, tax, and cancellation mechanics are governed by Paddle's Buyer Terms. See our Refund Policy for our refund window.
6. User content & AI outputs
You retain ownership of photos and meal data you upload. You grant us a limited license to host and process this content to provide the service. AI carb estimates may be inaccurate; you are responsible for verifying outputs before using them. We reserve the right to remove content or suspend accounts for misuse.
7. Service level & warranties
We aim for high availability but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, CarbCue is provided "as is" without implied warranties of merchantability or fitness for a particular purpose.
8. Limitation of liability
To the maximum extent permitted by law, our aggregate liability is limited to fees you paid in the 12 months before the claim. We exclude liability for indirect, consequential, or special damages, except where liability cannot be excluded by law (such as fraud, death, or personal injury caused by negligence).
9. Suspension & termination
We may suspend or terminate your access for material breach, non-payment, fraud or security risk, or repeated policy violations. When access ends, you may request export or deletion of your data.
10. Changes
We may update these Terms. Material changes will be notified via the app or email. Continued use after changes means you accept them.
